    Section 75 Question – I’ve never used or know anything about Section 75 so excuse my ignorance. I bought a 6 year old car for £36,000 during lockdown (1st March 2021) It was bought without seeing the vehicle in person, they wouldn’t budge on the asking price and on the day the delivery driver was picking the car up they sent me another video and I noticed the alloys needed to be refurbed. The salesman agreed they would take the car back a week later to refurb them as well as a couple of other issues (208 mile round trip). Anyway when it was delivered back to me I discovered not only had they not rebalanced the wheels they had only skimmed the front face of each wheel (Diamond Cut) and left razor sharp edges on each spoke. When I have sent photos of the sharp edges and of each wheel on the wheel balancing machine some 35g-45g out and photos of the old rusty weights still attached I questioned them not doing a full refurb as agreed in an email. They have agreed to reimburse me for rebalancing (£48) but they aren’t prepared to pay to get them refurbed locally to me at £400+VAT to bring them up to “my standard” (Their words) I work in the automotive industry within design and I am a time served machinist. Other issues have been faulty lambda sensor which they have paid for, small dent in door which they have repaired, paint missing on boot which they have touched up (poorly, but is well hidden) Another outstanding issue is the charger (Hybrid) has stopped charging the car, been to dealers and will charge on their set up so I need to buy a new charger now (£200-£300 on eBay) Where do I stand? I paid £6,000 on my wife’s AMEX.

      Paul u purchased a 6 year old car, if you wanted a new one with zero issues maybe you shouldn’t of been a tight arse and got yourself a brand new one instead.

      6 year old cars are not brand new and you can’t buy champagne on lemonade money then complain when it tastes bad.

        Is this an exam question or something? Is this a credit card blog or a mileage blog?

        Goods are over £30k so S75 doesn’t apply. Who buys a car without seeing it anyway?

      Any car dealer taking payment from a credit card is basically crazy if people cry S75 for minor defects like this.

      If you’re not happy ask them to take it back and refund. See what they say.

        The price is irrelevant… It’s still 6 years old and not brand new.
        You must accept some minor wear and tear and it sounds to me like the dealer has done more than enough already.

      I totally accept general wear and tear which there is minor paint chips but you are missing the point, they agreed to refurb the alloys and they haven’t fulfilled that.

        The option here is to refuse the car if it’s not as advertised. Section 75 only comes in if they refuse to take it back. On another note, not sure you would really want to diamond cut it again, you say you’re in the trade so you’ll know, diamond cutting again and again not recommended.

          Yea there is still enough material on the face to take another skim. With the razor sharp edge which will eventually fail and then water damage will get under the lacquer they have made them worse than when the car was sold to me but you have to give them the opportunity to correct them especial as they admitted fault, so to speak and insisted the car went back to them to have the wheels refurbed. If I knew what I knew now I wouldn’t of bothered and got them done properly locally but they wouldn’t let me. And if I could of seen the car in the flesh I would of been able to barter better on the price the fact they wouldn’t budge over the phone I was expecting better condition! Its there incompetence I am questioning. Who puts tyres on a wheel and doesn’t balance them?

        Get it refurbed at a local garage and put a s.75 claim through the credit card provider and await the outcome

          Better to have gotten this advice before purchase.

      Is the car in your name, but paid thru wife’s card?
      If yes, You have zero protection thru credit card.

        His wife paid for it as a present…Now it would have been covered if it was £29,999

        Given it cost £36k it’s over the s75 limit anyway so makes no difference whose card it was or who the car is registered to.

    Just had my June flights to Dubai cancelled. No BA flight to Dubai until 23 June now.
    Do BA believe UAE will stay red?

      Bottom line is that tourist demand drops sharply as you head into the Summer and Emirates is already running a big schedule. Forward bookings are presumably very weak due to current red list status.

    Isle of Man reducing quarantine from UK to 7 days in May if UK is below 100:100,000 for seven days, with a view to removing restrictions on 28 June, subject to UK vaccinations.

    Are you going to tell us which car? this might impact on level of perfection.

    Is it 2 weeks these days that you have, after delivery of something ordered remotely, to reject? then a further 2 weeks to return it? How soon after the charger fault became apparent did you reject it? Was there any warranty offered with purchase or are you left only with your statutory rights to rely on?

    Best motor site I know is honestjohn dot co dot uk. Havent looked at it for a while but they did have a really excellent legal guy who might have answered a similar question and, I think, had a flat rate offer in his own practice to give an initial level of advice to indivudual queries (IIRC region of £250-350 sounds like well worth considering for your issue.

      Thanks for your more concerning approach Lady London. The car in question is a Porsche Cayenne S E-Hybrid. Yes I was aware of the long distance selling rights which is 2 weeks, that time has now passed no thanks to them keeping the car over a week when it went back to fix all the original issues (2 out 4 to my satisfactory) The Lambda sensor issue I fitted my self and pocketed £200 (Almost half the cost to get the wheels redone, but not the point) The charger fault happened on 25th March so almost at the end of week 4 of owning it. The car was then booked into a local garage to get looked at and hopefully be covered under a 6 month warranty the car came with, however the garage it went to couldn’t diagnose the issue and the hybrid specialist they use had personal issues and wasn’t able to have a look at it anytime soon however one of the lads in the garage was ex-Porsche Technician (started at this new garage that same week) He mentioned to go to Porsche and try there chargers so I did and it worked so that to me says its the charger. All these garages I know people who work there including the Porsche one.

        I’ve spoken to the warranty company and as the charger is classed as an accessory they wouldn’t pay out for it which I thought would be the case. Just annoying as without it, it doesn’t function as a Hybrid car as I cant charge it up without the engine running.

          It really sounds as though it’s not fit for purpose which I thought was the acid test in consumer rights?

        When you say it’s “the charger” are you referring to the charge cable (mode 3 – 3 pin to type 2) or a proper type 2 charger you’ve have fitted to your home?

          Its the charge cable that has stopped working. VAG Group, Porsche has onboard charger. I worked at Bentley Motors which the Bentayga is the same platform, which is another reason I wanted to get the Porsche, the front end I know like the back of my hand. Nice to have something I influence the design off.

            I’m not sure on the “onboard charger” comment in relation to the cable that isn’t working. But sounds like the cars fine and the charge cable isn’t.

            You could have tested it at any type 2 compatible charge point (though unless it tethered you’d need the right cable)

            I’d invest in a 7kw wall charger rather than spend £300 on a new slow mode 3 charger cable, especially if you plan on future EV cars.

    sounds like rubbish. not an accessory. The point of a hybrid is you can charge either way depending on situation and you cant. what if you left it undriven esp in Covid for a bit you’d need to keep it charged. I’d tell the warranty company pay up or get sued.

    Alloys shoddy job we know Porsches are not as good mechanically as the name (sorry) but the look matters on a Porsche. Try your luck and sue the dealer for the unacceptable performance on the alloys it’s the weights that are the tell as you say. Get them fixed or replaced and bill them. You’re gonna have to fix them anyway as it’s a Porsche so might as well sue them with evidence photos statements of experts etc. MCOL’s not just for EU261 claims you know 😉

        Thanks Lady London. I’ll press them again, I’ve struggled as I’m on shifts at the moment, but plan to speak to them on the phone this week. A small win would be if they were to pay half for the wheel refurbish because I’ve pocketed £200 on the lambda sensor it would work out that they have paid for the refurb so I’m not out of pocket.

      actually on reflection the dealer might be the one to go after for the battery. Tbey might have been supposed to let you know if it didnt work (being essential functionality for a hybrid as you may well need to use it in sone situations) I think honestjohn might have commented similar cases where something very worn was not pre-advised in condition description of car

      If it’s a mode 3 charge cable on a 6 year old car you have to put it down to wear and tear.

      Rather than spend £300 on a replacement Porsche branded one I’d check out if any 3rd party ones work but in reality the charge speed is so damn slow it might be worth an investment in a proper 7kw wall charger, not sure if you get the grant with buying second hand cars though.

        The cars on board charger will only charge at 3.6Kw so no point in buying the 7Kw charger but good point for future proofing for EV. This is my first second hand car, first Porsche and first Hybrid. On your point for testing at any charge point I need to buy a cable as the one it came with is only 3pin plug into the unit and back out with Type 2 plug into car. Don’t want to buy that cable yet when I need to buy a replacement charge cable first. All extra expense on top of the original £36k that I wasn’t expecting.

    I’m over the moon today. The missus referred me for a BAPP from her Amex Platinum on Sunday and she’s already been credited the MR points today, 30,000!! Wasn’t expecting that much! We got our first points card just November past and already have over 120,000 points between us. Now just for the 2 for 1 voucher! Thanks Rob and everyone on this site for the tips and advice.
