Have you been ‘diagnosed with a psychological condition’ after the 2018 BA data breach?

If you signed up to the class action lawsuit against British Airways over the 2018 data breach, you may have received an email this week asking for details of your mental health.

As I understand it, some claimants will have to appear as part of the case, to be a representative sub-set of all claimants. Your Lawyers, which is working on the case, appears to be trying to find some suitable people.

These are the questions which Your Lawyers is asking people who signed up to the lawsuit to answer:

  • Were you suffering with any pre-existing mental health/diagnoses at the time you were notified by the British Airways regarding the breach?
  • If so, do you feel that your pre-existing condition has been exacerbated since learning of the data breach?
  • Since learning of the British Airways data breach have you sought medical attention as a result of distress caused by the breach?
  • If you have sought medical attention, on what date did you first do so following the breach?
  • Have you received a diagnosis of any psychological condition since learning of the breach?
  • Have you suffered any distress as a result of the breach?
  • If the answer to the previous question is yes, please provide a brief explanation as to how the breach has caused you distress

Since the breach, have you been affected by any of the following:

  • Feeling nervous, anxious or on edge?
  • Not being able to stop or control worrying?
  • Worrying too much about different things?
  • Trouble relaxing?
  • Being so restless that it is hard to sit still?
  • Becoming easily annoyed or irritable? 
  • Feeling afraid as if something awful might happen?

Over the last two weeks, how often have you been affected by any of the following problems?

  • Feeling nervous, anxious or on edge?
  • Not being able to stop or control worrying?
  • Worrying too much about different things?
  • Trouble relaxing?
  • Being so restless that it is hard to sit still?
  • Becoming easily annoyed or irritable? 
  • Feeling afraid as if something awful might happen? 
  • Do you continue to suffer with distress as a result of the British Airways data breach?
  • If you are no longer suffering distress as a result of the data breach, approximately how long did it take for you to recover from the distress caused by the breach?

    The American “where there’s blame there’s a claim” culture has always sickened me. The whole concept of class action reminds me a bit of vultures circling a dying animal waiting for the moment they can swoop.
    If you joined this one, good luck to you. I hope it fails but if not you enjoy any money you make from it as much as you deserve.
    Either way you will be paying the cost on any future flights.

      They are extremely talented and useful contributors to carrion disposal and dispersal in the savannah, and to compare them to these lawyers unduly tarnishes their reputation with cruel and libellous calumny.

    Absolutely disgusting what these lawyers are doing, how ridiculous to go down the mental health route, it’s just a farce and as noted above, will cost us more in the long run. Unfortunately there are people out there who can’t see the light for £££££ signs in their eyes.

      get a result is the aim the more they can get the better for their clients
      I thought that’s what they are supposed to do ?

        Chris, whilst I don’t disagree with you, I think this is a step too far…..it is all to do with pre-existing conditions and taking the victim as you find them….but really this is scraping the barrel a bit….if they succeed on this it will open the floodgates to everyone being able to claim for security breaches (which happen all too often on the internet now). If someone actually suffered a loss then I am 100% in agreement but if no loss, password changed then don’t make everyone pay for someone who was anxious for a while ‘in case’ they may suffer loss. Hard hearted….yes

        There are people whose job it is to send text messages to people advising of tax rebates or tax demands, purporting they are from HMRC…

        There are professional con artists, professional burglars and so on.

        And tax advisors that look for loop holes in legislation to reduce tax bills, to the detriment of government purses that ends up being detrimental to all other tax payers

          sayling Also there are people advising clients to buy islands abroad so they can pay less tax than the should or sell from Ireland to avoid as much tax/vat as possible or keep their money off shore

    If you suffer from the problems to the extent suggested in the e-mail, you’d probably be to nervous to book a flight you’d be far too sacred to get on in any case. Honestly.

    I find it hard to feel any sympathy for BA when a bunch of ambulance chasers are going after them with nonsense like this when BA just tell its customers that they wont rebook them onto other cancelled flights. If BA act so badly, why should other companies act nicely with BA?
